Terms and Conditions
We herein make application to Arizona Fasteners Corporation dba AF Distributors, collectively “Supplier”, for credit and/or to update and
reconfirm existing account and balance with Supplier. Applicant and/or client agree to provide Supplier with a current financial statement if
requested. If credit is granted, applicant promises to pay all invoices when rendered. Should credit privileges be denied, you may have the
right to know why. In the event that payment is not made and this account is referred for collection, applicant agrees to pay all costs of
collection equal to a minimum amount of 25 (twenty five) percent of principal amount owed. If an attorney is retained, applicant agrees to
reimburse Supplier for its reasonable attorney fees incurred, whether or not litigation is filed. Applicant also agrees to pay interest and
finance charges at 1 3/4 percent per month, compounded annually, unless limited by law to a lower rate, in which case the highest legal
rate shall apply. Applicant understands that all billing accounts receivable and credit functions of this firm are processed through
headquarters in Phoenix, Maricopa County, Arizona, or Tucson, Pima County, Arizona. Consequently, it is understood and specifically agreed
that in the event of suit or action, it shall take place in either Maricopa or Pima County at the discretion of the Supplier. Applicant specifically
understands that they are waiving the right to litigate outside of Maricopa or Pima County, Arizona. Applicant gives permission to Supplier or
its retained agents to verify and/or supplement the information given within. The terms and conditions of this application shall, upon
extension of credit by the company, constitute an agreement of sale.
Personal Guarantee
The undersigned agrees to unconditionally guarantee payment of all sums owed pursuant to this Agreement, and further agrees to all terms
regarding venue. This is, and is intended to be a continuing guarantee and shall not be revoked except by written notice to Supplier.
Guarantor signatures MUST be that of: OWNER/PARTNER/CORPORATE OFFICER.
Credit Report Consent
** Signature Changes to the Fair Credit Reporting Act require that the seller or creditor is required to obtain written permission from the principal of Owner/Corporate Officer please print name date officers of a corporation to allow the release of consumer reports on the officers prior to obtaining a credit report. **
The undersigned hereby consent(s) to Arizona Fasteners use of a non-business, consumer credit report on the undersigned in order to
further evaluate the creditworthiness of the undersigned as principal(s), proprietor(s), and/or guarantor(s) in connection with the extension
of business credit as contemplated by this credit application. The undersigned hereby authorize(s) Arizona Fasteners to utilize a consumer
credit report on the undersigned from time to time in connection with the extension or continuation of the business credit represented by
this credit application. The undersigned as [an] individual(s) hereby knowingly consent to the use of such credit report consistent with the
Federal Fair Credit Reporting Act as contained in 15 USC 1681 et seq.
